 'La Bâtisse' Cottage
Domaine Simples and Nature
 
Article 1 – Purpose
These general rental conditions apply to the rental of the holiday cottage 'La Bâtisse' located at 433 impasse des étangs, 24230 Montazeau.
The premises are rented furnished on a seasonal basis, excluding any professional, craft, or commercial activity of any kind, and only to travelers registered on the contract and under their full responsibility. Subletting is strictly prohibited. Any violation may result in the immediate termination of the rental agreement at the tenant's expense, with the rental income remaining the property of the owner.
The general rental conditions are subject to change at any time without notice. Payment of a deposit or the balance confirms the tenant's and any other person participating in the stay's unreserved acceptance of these rental conditions, even if the signed agreement has not been returned.
Article 2 – Length of stay 
The tenant signing this fixed-term contract may not under any circumstances claim any right to remain on the premises after the end of the stay.
Article 3 – Conclusion of the contract
The reservation becomes effective once the tenant has sent the owner a deposit of 25% of the total rental amount. The signed rental agreement must be returned at the time of booking.
For bookings made less than 7 days before arrival, the full amount of the stay will be payable at the time of booking.
By paying a deposit or the balance, the tenant agrees to comply with the rental agreement and the internal regulations.
Article 4 – No right of withdrawal 
For reservations made by mail, telephone or internet, the tenant does not benefit from the withdrawal period, in accordance with article L121-21-8 of the consumer code relating in particular to accommodation services provided on a specific date or at specific intervals.
Article 5 – Compulsory information
The full name, first name, mobile phone number, email address, and the full names of each tenant will be requested before arrival.
A police registration form will be required for our foreign tenants.
Article 6 – Prices
Prices are listed in Euros and are available on the website or upon request. They are also displayed in the cottage. VAT is not applicable. As prices are subject to change, only the price stated in the rental agreement is binding.
The nightly price includes the rental of the equipped cottage, the provision of sheets (beds made on arrival), a starter kit, end-of-stay cleaning up to 3 hours of cleaning and the following charges: water, electricity, wi-fi, household waste management, and the provision of wood according to the season.

Article 7 – Accepted Payment Methods

Article 8 – Settlement of the balance
The balance of the rental payment is due 7 days before arrival. The owner reserves the right to cancel the reservation if the balance has not been paid within the time frame stipulated in the contract.
Article 9 – Taxes and contributions
The amount of the tourist tax is not included in the price of the nightly stay but is indicated in the contract, subject to subsequent modifications of the contract.
Article 10 – Security deposit 
Upon arrival, a security deposit of €400 is required against the handover of the keys. This amount is increased to €600 if pets are present. The security deposit can be paid in cash against a receipt, by bank transfer (specifying "security deposit" as the purpose), or by credit card authorization.
After the check-out inspection and the cleaning of the accommodation, this deposit is returned within one week, less any cost of restoring the premises if damage is found.
Article 11 – Maximum capacity of the dwelling
The maximum capacity for the accommodation is 8 people, including babies and children. This number cannot be exceeded for safety and insurance reasons. We reserve the right to refuse access to the accommodation if the number of people exceeds the maximum occupancy allowed.
Article 12 – Contract Capacity 
This contract is established for the occupancy specified in the rental agreement. For two people, only the ground floor is available. If the number of people specified in the contract changes, please contact us to find out the terms and rates for additional tenants, which are at our discretion.
Article 13 – Visitors
The reception of visitors not included in the rental agreement who wish to visit you on an exceptional basis is subject to our approval. The cottage's facilities are strictly reserved for the use by the tenants.
If visitors wish to stay overnight, please refer to Article 12, Capacity of the contract. The installation of tents, the parking of caravans, or any form of camping is strictly prohibited throughout the property.
Article 14 – Parking
Our parking lot has a maximum capacity of 4 family-sized vehicles. We do not currently have an electric vehicle charging station. Charging your vehicle on the premises is strictly prohibited.
Article 15 – Arrival
Arrivals are between 4pm and 8pm. Please let us know your estimated arrival time if possible. In case of late or delayed arrival, the tenant must notify the owner.
Self-check-in is possible in case of late arrival.
Article 16 – Departures
The tenant must vacate the premises before 11am on the day of departure. An additional night's charge will be applied for any delay exceeding 45 minutes.
Article 17 – Use of the premises
The tenant must ensure the peaceful nature of the rental and use it in accordance with the intended purpose of the premises.
The tenant cannot oppose the inspection of the premises if the landlord requests it.
Please note that the cottage is in the countryside: there are two ponds on the property, as well as animals and farm equipment. A high voltage power line crosses the land, away from the houses. The client acknowledges and accepts the presence of the power lines as well as any potential inconveniences related to the rural environment and the presence of animals on the property.
Article 18 – Change to your stay 
Any requested changes to your stay, including dates, location, duration, or number of people, must be approved by Domaine Simples et Nature. Additional charges may apply.
In the event of unforeseen circumstances, we may have to modify or cancel your stay. Subject to availability, we will then offer you an equivalent stay on different dates. If this offer is not satisfactory, you will receive a full refund. No further compensation will be due.
Article 19 – Cancellation by the tenant or non-presentation
All reservations are firm 7 days before the start of the stay. Cancellation is possible before this deadline.
No refunds are given for interrupted stays. Furthermore, if the stay is shortened or the arrival date is delayed, the rental price remains payable to the owner.
In case of no-show, no refund will be given, and the full amount of the reservation will be due.
Article 20 – Cancellation by the owner 
The landlord refunds the tenant the full amount paid.
Article 21 – Cancellation during your stay
The owner reserves the right to cancel a stay if they observe serious and repeated breaches of their internal regulations without the tenant being able to claim any financial compensation.
Article 22 – Force Majeure
Force majeure is defined as any event beyond the control of the parties that is unforeseeable, insurmountable, and external to them, preventing either the client or the establishment from fulfilling all or part of its contractual obligations.

Events of force majeure or fortuitous events are those typically recognized by French courts and tribunals. Neither party shall be held liable to the other for any failure to perform its obligations resulting from a force majeure event. It is expressly agreed that force majeure suspends the performance of the parties' reciprocal obligations and that each party shall bear its own costs arising therefrom.
Article 23 – Inventory of premises
An inventory of fixtures drawn up by the owner is made available upon arrival; this inventory may be contested by the tenant within 12 hours of moving into the property. The cleanliness of the property upon the tenant's arrival must also be noted in the inventory.
In the absence of any dispute, the condition report is deemed to be accepted without reservation by the tenant.
The tenant is responsible for cleaning the accommodation during the rental period. Before leaving, the tenant must leave the accommodation in a clean condition.
The cleaning fee included in the rental price corresponds to 3 hours of service (cleaning and laundry included). Otherwise, the tenant agrees to pay for additional cleaning at a rate of €30 per hour.
If any items are broken or damaged during the stay, the tenant must report it immediately and the landlord may claim their replacement value.
Article 24 – Parties and gatherings
Any party or gathering is strictly prohibited. Failure to comply with this clause will result in immediate termination of the contract without compensation, and the security deposit may be forfeited in full to restore the premises to order.
Article 25 – Bringing a pet
A maximum of 2 dogs is allowed. We unfortunately cannot accept cats. For other animals, please contact us ahead of booking.
If the tenant arrives with more dogs than the permitted capacity, the landlord may refuse access to the accommodation and terminate the contract without any possible compensation.
Dogs are accepted under the following conditions:
- The tenant must inform the owner at the time of booking if they will be bringing a pet and specify its breed and age.
- We reserve the right to refuse a pet (please contact us at the time of booking).
 - The dogs must remain on the ground floor of the cottage and must not be allowed on the sofas or beds.
- They must not roam freely on the property or enter the fields and must be kept on a leash outside the cottage garden, and near the fields and buildings.
- The tenant must have liability insurance covering the animal.
- We recommend that the animal be vaccinated and treated with a parasite preventative before the stay.
- The tenant must ensure that their pet is compatible with our own animals on the property: dogs, horses, chickens, etc.
- The tenant must always maintain complete control of their pet and monitor its behavior.
- The tenant must never leave their pet unattended in the cottage.
- The tenant must ensure the cleaning of the cottage accordingly: no hair, no odors...
If traces of the presence of your pet remain upon your departure (check out  inventory), a cleaning fee of €30 will be deducted from the security deposit, plus an additional charge corresponding to the costs incurred for the restoration of damaged property if necessary.
We provide your dog with a kit including food/water bowls, a towel, blankets to protect the sofas, poop bags… subject to availability.
Article 26 – Non-smoking area
Smoking is prohibited inside the property and near the stables, barns, or hay sheds. An ashtray is provided in the garden. Violation of this clause will result in termination of this contract. The security deposit may be forfeited in full to restore the premises to their original condition.
Article 27 – House Rules
In general, the tenant agrees to comply with the following rules:
Article 27.1: Septic Tank: The house is connected to a septic tank. We ask that you do NOT flush anything other than toilet paper down the toilet. Any unclogging service will be at your expense.
Article 27.2: Responsible use: please turn off the lights when you leave a room, do not let the water run unnecessarily, and do not leave doors and windows open if you are using the heating/air conditioning or when you are away.
Article 27.3: Electric vehicle connection: our electrical system does not allow us to accept the charging of electric cars.
Article 27.4: Smoke and CO2 detectors: These are installed for your safety. Do not disable them and report any possible malfunction to us promptly.
Article 27.5: Peace and Quiet: To preserve the peace and quiet of the premises, parties, gatherings, and other noisy activities are prohibited. We reserve the right to exclude guests causing a disturbance without refund.
Article 27.6: Smoking and vaping are prohibited inside the cottage, near the stables, barns and hay sheds. An ashtray is available outside.
Article 27.7: Please do not enter the fields where the horses are kept or feed them. If you would like to see the horses up close, we will gladly accompany you.
Article 27.8: Children on the property are the sole responsibility of their parents or guardians. Due to the presence of ponds, farm equipment, and animals, children must not wander unaccompanied on the property.
Article 27.9: It is strictly prohibited to swim in the ponds.
Article 27.10: Household waste: A rubbish bin and recycling bins are provided. Please respect the recycling guidelines. Upon departure, please empty all bins and leave them clean. The rubbish bins, recycling bins, and compost bin should be placed in the container outside at the rear of the cottage.
Article 27.11: In case of drought the use of the BBQ is prohibited.
Article 27.12: In case of breakdown or malfunction, please contact us immediately. We will then do our best to resolve the situation. No refund for troubleshooting or repairs will be issued without our prior agreement.
Article 27.13: As the cottage has been carefully furnished, please respect the items and equipment provided. In case of major breakage (a broken glass happens to everyone!), damage, or deterioration, please report it during your stay.
Article 27.14: On the day of departure, please put away the dishes, empty and clean the refrigerator, and take your rubbish to the designated area (see Article 27.10). Thank you.
Article 28 – Insurance
The tenant is responsible for all damage caused by them. They are required to have vacation rental insurance to cover these risks. Please contact your insurance company for more information.
For tenants staying with a pet, they must be covered by liability insurance for the animal in question.
The tenant can purchase cancellation insurance for their stay from a third-party provider (bank card, Europe Assistance, etc.).
Article 29 – Valuables and access to property
It is recommended not to leave valuables in the accommodation. Domaine Simples et Nature cannot be held responsible in case of theft or damage.
Accommodation access: Please lock your accommodation upon leaving the premises. You are responsible for any theft or damage resulting from failure to comply with this rule.
Article 30 – Payment of charges and other services
At the end of the stay, the tenant will have to pay for charges not included in the price (tourist tax, etc.) and paid services offered by the establishment such as meal boards, grocery delivery, etc. The amount of these charges and services has been made known to the customer on the website and by display in the cottage.
Article 31 – End-of-stay cleaning
Cleaning is your responsibility during your stay. Cleaning supplies are provided for this purpose. A 3-hour cleaning fee is included at the end of your stay. If the accommodation is left in an unsatisfactory state of cleanliness and tidiness, we reserve the right to charge you a cleaning fee of €30 per additional hour worked.
Article 32 – Claims and disputes
In the event of a problem beyond our control (power outage, water outage, WIFI outage, etc.), Domaine Simples et Nature cannot be held responsible and no refund will be issued.
For any complaints, please do not hesitate to contact us directly so that we can try to find an amicable solution.
These general rental conditions are subject to French law.
Consumer dispute – mediation
In the event of a dispute between the customer and the company, they will endeavor to resolve it amicably (the customer will send a written complaint to the professional or, where applicable, to the professional's Customer Relations Department).
If no amicable agreement is reached, or if the professional fails to respond within a reasonable period of one (1) month, the customer, a consumer as defined in Article L.612-2 of the French Consumer Code, has the option of contacting, free of charge, the competent mediator listed on the register of mediators established by the Consumer Mediation Evaluation and Control Commission pursuant to Article L.615-1 of the French Consumer Code, if a disagreement persists, namely:

Article 33 – Data Processing
The personal data collected during the booking process is necessary for processing your request and fulfilling the contract. In accordance with the General Data Protection Regulation (GDPR), you have the right to access, rectify, object to, and delete your data by contacting us at the following address: caroline.t2930@yahoo.com. Further information can be found in our privacy policy on our website.
The owner undertakes not to transmit under any circumstances the information that the client has provided to him to other companies or organisations for advertising purposes.
The establishment offers free Wi-Fi access allowing guests to connect to the internet. The guest agrees that the computer resources made available to them by the establishment will not be used in any way for the reproduction, representation, distribution or communication to the public of works or objects protected by copyright or related rights, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the rights holders as provided for in Books I and II of the Intellectual Property Code when such authorization is required.
The photos displayed on the website and mobile app are for illustrative purposes only. Variations may occur, particularly due to changes in furniture, renovations, weather conditions, etc.
Article 34 – Email subscription
Acceptance of our general rental terms and conditions constitutes acceptance of our email subscription. We send a maximum of three emails per year, primarily to inform you about our activities and offer discounts on our services. If you wish to unsubscribe from our mailing list, simply let us know by email: bonjour@domainesimplesetnature.fr.
Article 35 – Final Provisions
The Client acknowledges having read and accepted these general rental conditions and any annexes thereof, prior to arrival at the rental and signing of the rental contract.
